SOFTWARE LICENSE

1. OWNERSHIP

The Software is proprietary to WARFARE and is protected by copyright laws, international treaty provisions, and other intellectual property laws. WARFARE retains all right, title, and interest in and to the Software, including all intellectual property rights therein.

2. RESTRICTIONS

You may NOT, without prior written authorization from WARFARE:

• a)Copy, reproduce, or duplicate any part of the Software
• b)Modify, adapt, translate, or create derivative works of the Software
• c)Reverse engineer, disassemble, decompile, or attempt to derive the source code of the Software
• d)Distribute, sublicense, lease, rent, loan, or transfer the Software
• e)Remove, alter, or obscure any proprietary notices on the Software
• f)Use the Software to develop competing products or services
• g)Publish, display, or make the Software available to third parties
• h)Use the Software for any unlawful purpose

3. CONFIDENTIALITY

The Software contains trade secrets and proprietary information belonging to WARFARE. You agree to maintain the confidentiality of the Software and not disclose it to any third party without prior written consent.

4. NO WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WARFARE DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

5. LIMITATION OF LIABILITY

IN NO EVENT SHALL WARFARE OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. TERMINATION

This license is effective until terminated. WARFARE may terminate this license at any time if you breach any of its terms. Upon termination, you must destroy all copies of the Software in your possession.

7. GOVERNING LAW

This license shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
